Any snagging issues will be corrected within 15 days
Independent arbitrators to be used in the event of any disputes
Final Deed of Purchase and Sale signed at public Notary on completion.
If final deed is not signed when due, being wholly or primarily the fault of Dunas Beach Resort, Sociedade Onipessoal Ltd, then the Purchaser at his choice may;
1) Charge Dunas Beach Resort, Sociedade Onipessoal Ltd interest from the date of non-compliance, on all amounts paid to date at a rate of Euribor at that timeplus 5 percentage points. The Purchaser may, at any point and from that point onwards, discontinue this remedy and select another amongst the ones mentioned in 2) and 3)
2) Terminate the contract and require all payments to be returned within 60 days
3) Ask for specific enforcement under article 830 of the Cape Verdean Civil Code
4 ) Pursue such other remedies as the law provides
Dunas Beach Resort Sociedade Onipessoal Ltd must sell the property free of all charges, expenses and encumbrances to the Purchaser.
Dunas Beach Resort, Sociedade Onipessoal Ltd must deliver to the Purchaser all keys to the property, which must be delivered completely finished in accordance with the plans and specifications as attached to the Promissory Contract.
Property registered at the Registrar.
Dunas Beach Resort Sociedade Onipessoal Ltd shall be liable for any defects or faults as follows;
a) 1 year for any defects in any manufacturers item
b) 1 year for any defect in the construction or materials used
c) 5 years for any serious construction defects
